Reglamento on criminal prisoners & justice in the presidios

Provincial State Papers, Benicia (Military), tomo I–XIX · BANC MSS C-A 15, document 177

Reglamento on criminal prisoners & justice in the presidios. For capital crimes by officers/soldiers, the governor/commander of the presidio forms the sumaria & advances the autos to sentence, remitting to the Comandancia General. Jurisdiction over the Spanish, mulato & mestizo settlers near the presidios is assigned to the captains (so they serve in war functions & to avoid jurisdictional discord) — no separate justice need be named. Detailed church-asylum (refugio) procedure: for a soldier in church asylum the captain forms the process, publishes edicts over nine days posted at the guardhouse; if a non-capital case, with caución juratoria the refugee is removed & 'corregido con caridad'; capital cases tried & remitted to the Capitanía General. Orig. pp.259–261.
