Causa de estupro vs artillero Ignacio Higuera for attempting to rape the ~5-yr-old girl Francisca…

Dep. State Papers, Benicia (Military), tomo LIII–LXVIII · BANC MSS C-A 18, document 359

Causa de estupro vs artillero Ignacio Higuera for attempting to rape the ~5-yr-old girl Francisca Valencia (14 Sept 1828); Argüello's cover-note calls it 'el tercer acontecimiento en pocos días en este presidio' (the third such case in days at SF) — 'exigen el remedio… los excesos de la maldad humana'; graphic child testimony (he dragged her to a second kitchen, gagged her with a roof-tile shard); inspection by a 'mujer perita' found blood on her shift; witnesses Antonino Buelna, Concepción Valenzuela, Mariano Uriarte. Higuera (18, native of SF) confessed; defense by Alférez Francisco de Haro (25 Sept 1828) argued the only proof is the confused child's statement, pleading 'la miseria del hombre'; fiscal Estrada left it to the consejo de guerra; remitted via Argüello to Echeandía — no final outcome recorded (ends n415). [a cluster of child sexual assaults at the SF presidio, 1828] ⭐ VERIFIED ON THE LEAF 2026-08-27. Span corrected: the causa runs through n415, not n410. DATE CORRECTED: Francisco de Haro's defence is headed on n413 'Defensa del reo. San Franco., Set. 25. 1828, por el Alfz. Fco. de Haro' - September, not October; read at magnification, and September is the only internally consistent reading.
