Dep. State Papers, Benicia (Military), tomo LXIX–LXXVII · BANC MSS C-A 19, document 177

Causa for the robbery of the Monterey national-treasury almacén (reported 28 Sep 1830 by comisario Manuel Jimeno to Alcalde Mariano Soberanes), with the Indian Atanasio as the accused. (Header: 'Ejecución del reo' — i.e., the accused was *executed*.) Fiscal Ibarra (16 Mar 1831) asked 2 yrs presidio (per the 1788 law on presidiarios robbing the Hacienda; goods worth $219); defender Vicente Ríos pleaded Atanasio's minority (<18) & that the value didn't reach $100; but Asesor Gómez found the crime aggravated (against national interests, in an official's house, by his own domestic). Outcome: Atanasio condemned to death and SHOT on 26 April 1831 at 11 AM — Gómez applied the military ordinance (R.O. 31 Aug 1772) + old Castilian law, 'pasado por las armas' (the gallows having been abolished by the 1812–13 Cortes & 1832 Mexican decrees); Victoria confirmed 23 Apr, capilla then execution, fiscal & escribano certifying. ⚠️ A harsh capital outcome — execution for a ~$219 treasury robbery by a minor neophyte. → Expanded Entry F (special record). Orig. pp.180–309.
