'Sedición de Antonio Ávila' — investigation of a convict-band uprising in the 1832 civil conflict

Dep. State Papers, Benicia (Military), tomo LXIX–LXXVII · BANC MSS C-A 19, document 183

'Sedición de Antonio Ávila' — investigation of a convict-band uprising in the 1832 civil conflict. Antonio Ávila led a band of presidiarios (from Santa Margarita) recruited & armed by Don Vicente Sánchez (the LA diputado; arms taken from Santa Bárbara, distributed at the Cerrito de los Voluntarios). The plan: join the Mazatlán squadron under Tte. Ibarra to fight the 'San Diego party' / oppose Zamorano (the northern Comandante), framed 'en defensa del Supremo Gob.no'; comisario Joaquín Gómez (SB) supplied goods; documents from Mariano Estrada, Rafael Gómez, Joaquín Gómez named. Six convict-deserters (Ignacio Olgadillo, Antonio Rivera, José Mª Blanquel, Catarino López, Joaquín Alfaro, Guadalupe Martínez) deposed — they deserted on realizing they'd been deceived by Sánchez & Ávila. A key datapoint on the 1832 post-Victoria civil war (Zamorano's north vs. Echeandía/Sánchez's south). ⭐⭐ Vicente Sánchez claimed parliamentary immunity (as a territorial Diputado, Const. Art. 336 + the 24 May 1813 Cortes decree) to refuse testifying; Asesor Gómez ruled the immunity didn't cover an act 'muy distante de sus atribuciones.' ⭐⭐ Conclusion: Gov. Figueroa (1833) dismissed the whole case under the AMNESTY law of 25 April 1832 — the accused already free & the cause unsubstantiated; sobreseído y archivado. ⚠️ n355–n362 read at sample leaves (repetitive convict-deserter testimony).
