Provincial State Papers, tomo III–IV · BANC MSS C-A 2, document 65

THE HABILITADO FISCAL CONSTITUTION — the complete legal architecture of the office ('Resoluciones… sobre el manejo de intereses de las Tropas presidiales y volantes'): (a) the 1780 Comandancia resolutions (Arizpe 21 Sep 1780): habilitados may NOT buy on credit, borrow, or obligate the company — creditors recover from the habilitado's OWN goods; quiebra rules (shortfalls made good from Cajas-Reales deposits & his property); art.9–10: shortfall → the habilitado's ARREST + reintegration from his goods; the captain regulates each soldier's & family's weekly ration by individual lista w/ VºBº; ⭐ captains PERSONALLY liable ('la pagará de su propio caudal el Capitán… que por su omisión hubieren dado lugar') for negligently unmanaged soldier debt, inferior goods, or overpricing — penalties up to privación de empleo, the ayudantes inspectores vigilating under the same responsibility; (b) NEVE'S PENINSULAR ADAPTATIONS (Rl. Presidio de Sta Bárbara, 20 Jun 1782, effective 1 Ene 1783): SEMIANNUAL ajustes; the habilitación may not fall on the Comandante (if so, the Alférez intervenes the accounts); semiannual credit/debit relaciones; June + December inventories formed by the habilitado, intervened by the 2º oficial + two company-named apoderados at the cotejo de géneros; annual January cuenta general de fondos per the Reglamento; family-rations set annually by household size/ages, sourced 'en cuanto sea posible' from the Pueblos y misiones [the provincial-economy principle]; debtors relieved 'prudentemente' via the retention fund; the borrador & limpio cuadernos kept current — accounts unpunctual at the Inspector's arrival = 'prueba de omisión y culpable descuido'; delay beyond 8 DAYS at a revista = 'prueba de confusión y mala versación.' Certified from González's original by Fages, Monterey 30 Dic 1782. The statutory frame for every later habilitado case (Sal's 1787 embargo, Herrera, the Mexican-era comisarías) → the Sal papers keystone document
