Figueroa's *informe reservado* on the Híjar–Padrés affair — the constitutional heart of it

State Papers, Missions and Colonization, tomo II · BANC MSS C-A 53, document 106

Figueroa's *informe reservado* on the Híjar–Padrés affair — the constitutional heart of it: because the 25 July 1834 supreme order separated Híjar from the political command, and his power to manage mission property was given him only *as* Gefe Político, 'habiendo cesado en este encargo, ninguna otra investidura le autorizaba'; the Diputación would be 'culpable' if it obeyed his pretensions, and does not consider the law authorizing the Supreme Govt to dispose of mission goods applicable. Narrates the Padrés / two-commissions incompatibility (enclosed copies Nº 1–2 = Docs 97–98) and — the political core — accuses Padrés of 'fomentar secretamente especies subversivas' on the frontier with the colonists, inventing 'las más atroces calumnias' to raise public odium and form a *partido* against him, resentful that Figueroa blocked the 'dilapidación de los intereses de las misiones' he and Híjar sought to seize; Figueroa offers to resign the political government, keep only the Comandancia, and warns the colony may commit 'atentados que sea preciso castigar'
