THE ARMIJO/EGGER/SMITH TRIAL (Spanish version, cf. ⭐⭐⭐ doc 185): per instructions to try the criminal cause against Armijo, Egger y Smith for the Sacramento Indian killings, presented himself at Sutter's on the 30th; on the 31st a tribunal was set & copy of the accusation given the accused, save Armijo (absent, gravely ill, cannot be moved); Samuel Smith had come as an agent of all the upper-Sacramento people, saying some Indians had found several corpses supposed killed by Armijo & his party; Sutter deposed that S. Smith told him Indians live 200 mi up-river, all savages, generally at war among themselves; consequently postponed the trial to 18 Oct; as the witnesses & all the Sacramento people are represented by S. Smith, & finding no impartiality to form the jury, thought it better to move the trial to another jurisdiction; went to Sonoma to await orders
