Robo de caballos by Tulares gentiles. The gentile Chaguanic[?] (ranchería ~20 leagues from San Miguel) + 3 others stole 102 horses (he confessed 111) from Mission Soledad (Mar 1831); pursued by mission people — one accomplice (Tancho) killed resisting, 2 escaped, Chaguanic captured (confession via interpreter). Fiscal recommended 4 yrs presidio. ⭐⭐ Asesor Gómez: a gentile 'no está sujeto á las leyes penales nuestras' (though force, even lethal, may repel his aggressions); recommends he be freed & placed in a mission (Monterey–SF) for instruction 'en las verdades del Evangelio… [y] lo paternal del Gob.no,' so neither impunity nor offense to 'los derechos de la humanidad.' Note: 'Fugó antes de q[u]e se pusiese en libertad.' Orig. pp.108–129.
