The Ignacio Leonardo Herrera ecclesiastical-asylum causa (the concrete case behind Doc 93)

Dep. State Papers, Benicia (Military), tomo LXIX–LXXVII · BANC MSS C-A 19, document 94

The Ignacio Leonardo Herrera ecclesiastical-asylum causa (the concrete case behind Doc 93). The civilian Ignacio Leonardo Herrera (age 29, native of Guadalajara; escribano + 'principios de flebotomía') knifed the cavalry-sentinel Miguel Castro (cuts to arm/finger/back) on 17 May 1830, in revenge after Castro drove him 'á cintarazos' from the calabozo (where he'd gone to give prisoner Hilario García tobacco) and mocked him; Herrera pleaded he acted 'ciego de cólera.' He then fled the jail in his shackles and took refuge in the Mission San Diego church, claiming ecclesiastical immunity (asilo/retraimiento) — touching off a long church-vs-state battle. Fiscal Ignacio del Valle extracted him under a 'papel de iglesia' (caución juratoria) citing the order of 7 Oct 1775; Fr. Vicente Pasqual de Oliva (SD) and Father-President Fr. José Sánchez (San Gabriel) defended the asylum (Gregorian bull *Cum alias nonnulli*; Benedict XIII/XIV; the 1814 Francisco de Asís precedent), while Asesor Lic. [Rafael] Gómez ruled the crime excepted (alevosía; the bull 'no está recibida' in Spain; R. Órdenes 1750/1775/1787/1794). Outcome: Herrera sentenced to 8 años de presidio (Gómez, San Carlos 6 Nov; Echeandía decreed 22 Nov; finalized 19 Jan 1831); SD cmdt. Santiago Argüello protested Herrera was 'sentenciado sin oír el alegato de su defensor.' → verbatim in Expanded Entry B. ⚠️ This Herrera (civilian scribe, b. Guadalajara) is distinct from subcomisario José Mª Herrera (the Solís ally). Orig. pp.535–645.
