Margin mark x. Spans n105-n107. Heading “Sobre indulto del delito de Contrabando.” The King, wishing to check the damage done by vassals engaged in contraband trade “y atendiendo á la triste suerte de sus familias, aunque delinquentes,” grants general indulto of the delito de contrabando to all who have not been homicides, or were so involuntarily, and to deserters of the ejército ó armada, presenting themselves within two months — deserters first to serve out their empeños, the rest before the subdelegados de Real Hacienda. Nine instructions follow: 1 present to the subdelegados and hand over the tobacco, arms or other illicit goods; 2 bind themselves not to return to contraband, take up an honest occupation and give fianza of 200 pesos fuertes or more; 3 relief from bail on proven impossibility; 4 defrauders and soldiers already jailed for the same offence are included and are to be freed to comply; 5 no contrabandista may leave his fixed residence without stating cause to the justicia; 6 subdelegados to send the pueblo judges testimonio of the obligation and fianza; 7 negligent justicias fined 400 pesos the first time and double the second; 8 those not presenting in time to be pursued “con el mayor rigor”; 9 the decreto and instrucción to be entered in the libros del ayuntamiento and read by its escribano to the incoming alcaldes each new year, under 200 pesos fine if the reading is omitted.
