SESSION ACTA Heading verbatim: 'o 1834 = Junio 26. / Diputacion Territorial = Sobre prohibicion de matanzas de ganado. Admision de renuncia de Srio. &ª' [= 1834, June 26. Territorial Deputation. On the prohibition of cattle slaughter; acceptance of the Secretary's resignation, etc.] Previous acta read and approved. Oficio of the Alcalde of Sn José de Guadalupe reporting that the Ayuntamiento of that pueblo had named C. José Fernandez Srio del Juzgado (to the Comisión de Gobº). ⭐⭐ Oficio of the R.P. Fr. Franco García Diego acknowledging receipt of the order prohibiting the matanzas de ganado being made at some misiones, and stating that although in those of his charge it had not been done in that manner he would circulate his orders in compliance; ordered archived. This is the mission-side receipt of the matanza suspension enacted on 12 June. Second reading of the colonización y terrenos valdíos dictamen on the land grants to Joaquín Bernal and Juan Alvarez, set for the following session. Dictamen of the Comisión de Gobº on the bando de policía published by the Alcalde of this Capital on 6 January of the present year, cited for discussion today: Carrillo (D J A.) said he was not informed in detail of the bando and wished to be, in order to enter on discussion; the matter was suspended for resolution at the immediate session. ⭐⭐ ALVARADO'S RESIGNATION ACCEPTED: the expediente of the Secretary's resignation, left pending by the acta of the 14th, taken up; the Comisión de Gobº dictamen admitted in general and its three articles discussed. Art. 1, first drafted as conceding the Secretary what he asks and noting that under art. 4 of chapter 2 of the Decreto de 23 de Junio de 813 the Secretary can be removed only by the Diputación with the Government's concurrence, so that since the appointment never received superior approval there is no impediment, was withdrawn by the commission and redrafted on the spot as: 'Se exonera á Dn Juan B. Alvarado del empleo de Srio de la Diputacion Territorial que ha servido y solo continuará sus funciones hasta el momento qº se presente su sucesor.' APPROVED UNANIMOUSLY, the appointment of a successor being deferred to the next session. Art. 2 declared legal the sums the Secretary states are owed him, 'acendientes á un mil ciento setenta y nueve pesos cinco reales', and recommended their prompt satisfaction. Carrillo (D J A.) objected that the account the Secretary presented does not appear sufficiently justified to legalise the alcances it indicates, being drawn up by the interested party himself; Carrillo (D C.) defended the commission. The PRESIDENT said the account is a relación in which Alvarado himself set out his assignments with certifications and the sums the síndicos of some points have paid him on account, but that this is a matter the Corporación should not occupy itself with, being proper to the officer of the contaduría the Diputación ought by law to have; he asked the matter return to the commission until the Tesorería is systematized, then be examined and returned to the body for approval if found convenient, and remarked that some day these sums might perhaps be covered, such at present being the scarcity of funds 'que no han dado pª cubrir los gastos erogados en la compostura del salon de Sesiones'. ART. 2 TOTALLY REJECTED on a vote, the affirmative being Sres. Carrillo (D C.) and Estudillo. Art. 3, that Alvarado cease in the comisión de contador de propios y arbitrios entrusted to him by this Corporación on 16 July 830, was objected to by Carrillo (D J A.) as outside the commission's brief since the Secretary's petition does not refer to it; Castro answered that a later law establishing a Contaduría General de propios in the capital of Mexico derogates the one that gave rise to the appointment, so that the Secretary must in fact be excluded from it; ART. 3 APPROVED. The President then moved an additional article, admitted and APPROVED at once: that the Gefe Político, in communicating to the Secretary the resolution on his separation, give him in the name of the Corporación 'las gracias por la honradez, desinteres y exactitud con que ha desempeñado sus funciones'. [Beyond the band, on n136-n138, the same acta takes up the reglamento interior project: art. 1 (deputies reaching the capital on 1 June under the Gefe Político's convocatoria to swear before him, whereupon the Diputación is declared installed) drew the President's argument that the commission had had art. 334 of the Spanish Constitution in view, mistakenly, since that article was given for the creation of these bodies and not for the epochs of their meeting, the Diputación in his view needing to exist all year with its sessions permanently open; Carrillo (D J A.) replied from the March sanction date of the Constitution that the measure could only be prospective; the President asked the article return to the commission for a measure closer to the Territory's present circumstances 'por el diferente sistema que la nacion ha adoptado muy distante del qº se adoptó en la constitucion de España'; the commission withdrew art. 1, then art. 2, then the whole project, offering to present the reglamento at the immediate session; acceded to, and the session adjourned.]
