SESSION ACTA Heading verbatim: 'o 1834. = Junio 3 = Mont. / Diputacion Provincial. Sobre ley de secularizacion, y no creer facultado á Gefe Polto para proceder á ella' [= 1834, June 3, Monterey. Provincial Deputation. On the secularization law, and on not believing the Gefe Político empowered to proceed with it.] ⭐⭐⭐ The 24 May dictamen debated and ADOPTED, article by article. Admitted in general, then taken in particular. CARLOS CARRILLO explained the commission's grounds for not believing the Gefe Político had any faculty to proceed to secularization, 'pues solo esta cometida esta facultad al ejecutivo de la federacion', and that the special commission the Government has sent to put the law into practice is positively known of. CASTRO wanted added: 'Sin perjuicio de que puedan tomarse providencias sobre el particular segun las circunstancias lo exijan.' ⭐⭐ FIGUEROA answered at length: since he saw the law he had meditated much on it and found only that the Supreme Government is itself empowered by the law to dictate all measures conducive to the enterprise, the law passing over in silence everything relative to 'medidas de tierras y distribucion de bienes'; that the 'ley de 29 de Nbre último' empowers the Government to use the 'fincas de obras pías' for secularization and colonization; that this leaves no doubt the Gefe Político has no faculty to undertake the business. He then gave his own account of 1833: that on his arrival in this country, through the missions of the southern part of the Territory, he BEGAN TO MAKE SOME 'separacion de familias poniendolas en varios puntos pa que fuesen formando sus pueblos', by virtue of the instructions the Supreme Government gave him when he came to receive the government of the country, but that the law ordering secularization having now arrived he SUSPENDED those operations. Article 1 APPROVED UNANIMOUSLY. On article 2 Carlos Carrillo argued the fondo was meant to give the new pueblos capital for works of common utility and a reserve to pay the maestros de primeras letras and curas; the goods marked are a small quantity that would be of scarce profit and would touch 'una parte muy pequeña á los neofitos de las misiones si se les repartiesen'. Castro thought the petition superfluous since the commission will bring its own instructions. Figueroa held the measure very convenient 'pa el engrandecimiento de estos Pueblos que van á nacer'; article 2 APPROVED. On article 3 Carlos Carrillo explained the object was that the law take effect as soon as possible and not be paralyzed for want of the competent number of seculares. Castro objected that the petition should not be made because in general the missionaries now in the Territory 'no merecen la confianza de altos encargos'. Article 3 APPROVED. Finally the Gobº dictamen on the formación y arreglo de Ayuntamientos was approved as presented, Carlos Carrillo explaining that requiring the expediente instructivo first is what the law demands and what leaves the bodies constituted in due form and forestalls reclamaciones.
