SESSION ACTA Heading verbatim: '1834. = Julio 31 = Mont. / Diputacion. Sesion del dia de la fha.' [= 1834, July 31, Monterey. Deputation. Session of this day.] THE ENACTMENT SESSION: the 1834 provisional reglamento for the secularization of the missions voted through article by article, 11 leaves of it. Opens with a dispute over the wording of the previous acta (Carrillo D. Jose Antonio holding that his proposition of the day before concerned the time in which the project should BEGIN, not be concluded); declared sufficiently discussed and the acta approved in the sense set out. Debate: Carrillo (D. C.) thought the term short, there being no chance to provide employees; Ortega read the proposition as beginning next month and not precisely with the ten. THE PRESIDENT'S REPLY (n19–n21) is the constitutional core: everyone is convinced of the goods the Ley de Secularisacion will produce and the E.P. was the first to make its panegyric, but if the means are erred it will produce evils; the territorial government acts as subaltern of the government of the Union, and both 'la ley de 17 de Agosto' and 'la de 26 de N.bre' empower the Supreme Government exclusively; 'en ningun caso la Diputacion ni el G. P. deberá sobreponerse á las leyes y al Sup.mo Gob.o por que no respetándose uno ni otro dejan de existir las garantias sociales y solo dominará el mas fuerte'; the Supreme Government has confided execution of the law 'al S.r Hijar,' and to anticipate him is to trample the government's respect; it is a mistake to think the law has produced no effect, 'p.r q.e de d.ro los indios son tan C. C. como todo mexicano y q.e unicamente en lo material falta arrancarlo del dominio de los religiosos'; that convinced of the need to forestall 'la total ruina de las Misiones por la mala vertacion y dilapidaciones q.e se advierten publicamente' he has resolved to unite his vote with the Diputacion 'p.a poner en posecion á los Yndios de la libertad q.e les esta concedida y distribuirles una parte de los bienes,' notwithstanding that he lacks the instructions the Supreme Government gave the director of Colonizacion; and that this endeavour has been his own and not that of SS. D. J. A. Carrillo and D.n J. Castro, who only asked that the temporalidades be administered by persons other than the religiosos, a measure which far from improving the Indians' condition would reduce them to a worse one 'dandoles nuevos amos.' Carrillo redrafted art. 1, striking 'conforme se lo permitan las circunstancias' and substituting 'dando principio en el proximo mes de Agosto, ejecutandose inmediatamente con diez sucecivamente con las demas'; approved. THE ARTICLES THEN VOTED SERIATIM, each 'Hubo lugar á votar y se aprobó': 1 (Gefe Politico to convert the missions partially into pueblos, beginning in August, ten first); 2 (missionaries relieved of the administration of temporalidades, exercising only their ministry until the formal division of parishes, the Supreme Government and the Diocesano providing parish priests); 3 (Territorial Government reassumes the direction of temporalidades); 5 (Distribucion de intereces y terrenos: to each head of family and to all over 20 years even without family, from the mission common lands, temporal or irrigated, a solar not over 400 varas by 400 nor under 100; in common, land sufficient to water their stock; ejidos marked for each Pueblo and in time propios); 6 (half the bienes semovientes distributed by proportional and equitable prorrateo at the Gefe Politico's judgement, on the basis of the estados de existencias lately presented by the Misioneros); 7 (half or less of furniture, tools and seed indispensable for cultivation); 8 (all surplus lands, real property and stock in the care of a mayordomo named by the Gefe Politico at the disposal of the Sup.mo Gob.o Federal); 9 (from the common mass, the subsistence of the Padres misioneros, pay of mayordomo and servants, costs of worship, policia y ornato); 10 (Gefe Politico to order all expenses for execution, conservation and increase); 11 (the missionary to choose his quarters in the Mission, with furniture and utensils); 12 (library, sacred vestments, jewels and church furniture in the Padre's charge under the responsibility of a sacristan of his choosing, equitably salaried); 13 (general inventories of all existencias of each Mission, books of cargo y data, all papers, and active and passive credits, reported to the Supreme Government); 14 'Gob.o Politico de los Pueblos' (organised in conformity with the laws in force, the Gefe Politico to provide for Ayuntamientos to be established and elections held); 15 (economic government to the Ayuntamientos, but contentious justice to the jueces de 1.a Instancia in the nearest places); 16 (emancipados obliged to attend the indispensable common labours for vineyards, orchards and sowings, which remain undivided until the Supreme Government resolves); 17 (emancipados to give the padre misionero the personal service needed for his attendance); 18 'Restricciones' (they may not sell, encumber or alienate the lands given them nor sell their stock; contrary contracts void; the Government recovers the interests as national property and the buyers lose their money); 19 (lands whose owner dies without heir revert to the nation, as copied: 'Los terrenos cuyos dueño misionero sin dejar heredero volverán á poder de la nacion'); then 'Prevenciones Gral.s' and 20 (Gefe Politico to name the comisionados needed for the plan); 21 (Gefe Politico authorised to resolve any doubt on its execution); 22 (meanwhile, the R.R.P.P. Misioneros forbidden to slaughter stock in considerable quantity, excepting the common and ordinary matanzas customary for the neofitos' subsistence, without waste). Carrillo (D. C.) then presented additional art. 23: the missions' passive credits to be preferentially satisfied from the common mass within the terms the Gefe Politico determines; approved. Finally 'Se preguntó si lo ventilado en esta y en las antecedentes Sesiones es de riguroso secreto, y declarado que si, se levantó la sesion.' Signed 'José Figueroa = José Maria Maldonado.'
